Luisa Kremleva, an Instagram model accused of falsely accusing AC Milan defender Theo Hernandez of rape, is set to go on trial later this month in a Costa del Sol court. Prosecutors are seeking a two-year prison sentence and a £12,000 fine if Kremleva is convicted of maliciously fabricating the claim.

The case dates back to June 2017, when Kremleva alleged that Hernandez, a French international footballer, raped her in a Porsche Cayenne outside the upscale Marbella nightclub Olivia Valere. She also claimed that Hernandez caused her knee injuries by pushing her out of the vehicle after forcing himself on her. Hernandez, who joined AC Milan from Real Madrid, denied the allegations, admitting that they had sex but insisting it was consensual.

The court initially archived the case after police obtained CCTV footage from outside the nightclub, which revealed that Kremleva sustained her knee injuries in an accidental fall, not from an assault. A judge ruled that there was no evidence supporting her claims, and Hernandez was never arrested.

Following this, Kremleva was arrested after refusing to respond to multiple court summons. Prosecutors allege that she accused Hernandez out of malice after he rejected her attempts to continue their encounter. Despite the case being shelved, public prosecutors reopened the investigation, pushing for Kremleva to face criminal charges for making a false accusation.

The trial is scheduled for October 28 in Malaga, and Kremleva will be required to appear in court. It remains unclear whether Theo Hernandez will need to attend in person or provide testimony via video link.

Kremleva’s mother, Mila, previously defended her daughter on Spanish television, stating that she had not been arrested and was merely complying with court notifications. Kremleva herself denied wrongdoing on social media, writing, "The truth will come out."

Despite the lengthy delay in the case reaching trial, court sources have confirmed that proceedings will finally move forward later this month. If convicted, Kremleva faces not only jail time but also significant financial penalties for her false claims against the football star.

Theo Hernandez, who has become a key player for AC Milan, had a difficult match against Fiorentina on Sunday, where he caused a penalty, missed another, and was given a red card, leading to a 2-1 loss for his team. The upcoming trial adds another layer of complexity to Hernandez’s personal and professional life, as he awaits resolution to a case that has shadowed him for years.
