The former couple, who are parents to their 9-year-old son Maceo, have come to a mutual agreement regarding their divorce and custody arrangements, as per a 33-page document obtained by USA TODAY.

The finalized decision, officially filed in the Los Angeles Superior Court on Tuesday, outlines that Berry, aged 57, and Martinez will share both joint legal and physical custody of their son. Additionally, Berry has agreed to provide Martinez with a monthly child support payment of $8,000, along with 4.3% of her income exceeding $2 million.

In addition to financial support, Berry will be responsible for covering Maceo's private school tuition, extracurricular activities, health insurance, and therapy expenses.

Halle Berry and Olivier Martinez exchanged vows in July 2013 and welcomed their son Maceo in October of the same year. Following a separation in October 2015, the couple officially filed for divorce.

Martinez's attorney, Matthew K. Skarin, shared, "The public documents filed in the matter should speak for themselves. The parties wanted more clarity in regards to Maceo's schedule and each of their respective time with their son."

According to the agreed-upon custody arrangement, Maceo's time will be divided between both parents during the week, with alternating custody on weekends. Special provisions apply for school holidays, Maceo's birthday, and occasions like Mother's Day and Father's Day.

The custody agreement also addresses communication, allowing Maceo one phone call or video chat with the non-custodial parent before bedtime, with a maximum duration of fifteen minutes.

Considering the emotional impact on their son, the agreement suggests individual and family counseling for Maceo, limited to twice a month during Halle's custodial time. These sessions may involve Berry's daughter Nahla, from her previous relationship with Gabriel Aubry. However, Berry's current partner, Van Hunt, is not included in these sessions.

To maintain a respectful environment, the agreement also specifies that both parties refrain from negative, disrespectful, or derogatory remarks about each other, their families, or significant others, especially when in the presence of Maceo or within his hearing range. This prohibition extends to public or social media platforms.

Halle Berry's divorce and custody agreement with Olivier Martinez provide insight into the complexities of high-profile separations, especially when children are involved. This resolution reflects a focus on maintaining a supportive and harmonious co-parenting relationship for the well-being of their son.
